Agreement

Next Best Outdoors (the "Service") is operated by Next Best Outdoors LLC, an Oregon limited liability company ("we", "us"). By creating an account or using the Service, including the website and mobile app, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Accounts

• You must be at least 13 years old to use the Service, and 18 (or have a parent or guardian's permission) to buy a subscription.
• Keep your login credentials secure. You are responsible for activity on your account.
• Give accurate information, and do not create accounts for anyone else without their permission.

Subscriptions and Automatic Renewal

• Pro is $6 per month or $60 per year, plus any applicable tax, charged in advance through our payment processor, Stripe.
• Your subscription renews automatically at the end of each billing period, at the then-current price, until you cancel.
• Cancel any time from Settings → Membership → Manage Subscription. Cancellation takes effect at the end of the current billing period, and you keep Pro until then.
• Payments are non-refundable except where the law requires otherwise. If you believe you were charged in error, contact us.
• We will give you notice before a price change takes effect on your subscription.

Your Content

You own the spots, logs, photos and notes you add. You give us a limited license to store, process and display them as needed to run the Service for you. We do not sell your content. You are responsible for having the right to share what you upload.

Acceptable Use

You agree not to:

• Scrape, bulk-download or resell data from the Service, or use it to build a competing product
• Interfere with, overload or probe the security of the Service
• Access another user's account or data
• Use the Service for anything unlawful

Our Service and Third-Party Data

The Service's software, design and scoring are owned by Next Best Outdoors LLC. Data from third parties (such as NOAA, USGS, Open-Meteo and state agencies) remains subject to those providers' terms. We may change, suspend or discontinue features, or suspend accounts that break these Terms.

Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service or its data will be accurate, timely, uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, Next Best Outdoors LLC and its members, managers and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any personal injury, property damage, lost catch, lost trip or lost profits arising from your use of or reliance on the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some jurisdictions do not allow certain of these limits, so they may not all apply to you.

Indemnity

You agree to defend and hold harmless Next Best Outdoors LLC from claims by third parties arising from your content, your breach of these Terms or your misuse of the Service.

Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of law rules. Disputes will be resolved in the state or federal courts located in Oregon, except that either party may bring an individual claim in small claims court.

Changes and Termination

We may update these Terms. For material changes we will notify you by email or in the app before they take effect; continuing to use the Service afterwards means you accept them. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (including the disclaimers, limitation of liability and governing law) survive.
